1. Agreement to Terms
By downloading, installing, or using the Deficit mobile application (“App”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree, do not use the App.
These Terms constitute a legally binding agreement between you and Deficit (“we,” “us,” or “our”). We may update these Terms from time to time. If we make material changes, we will notify you through the App or by updating the date above. Your continued use of the App after changes are posted constitutes acceptance of the revised Terms.
2. Eligibility
You must be at least 18 years old (or the age of legal majority in your jurisdiction, whichever is greater) to use Deficit. By using the App, you represent and warrant that you meet this age requirement.
3. Description of the Service
Deficit is a calorie and nutrition tracking application for iOS. The App provides food logging, diet cycle management, body composition tracking, AI-powered food detection, barcode scanning, and integration with Apple HealthKit. Data is stored locally on your device. The App does not require account creation and does not store your personal data on our servers.
4. Subscriptions and Billing
4.1 Subscription Plans
Deficit offers auto-renewable subscription plans that unlock premium features. Specific pricing, features, and trial offers (if any) are presented within the App at the time of purchase.
4.2 Billing and Renewal
Payment is charged to your Apple ID account at confirmation of purchase. Your subscription automatically renews unless you cancel it at least 24 hours before the end of the current billing period. Your account will be charged for renewal within 24 hours prior to the end of the current period at the rate of your selected plan.
4.3 Free Trials
If offered, a free trial provides access to premium features for the specified trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and your Apple ID account will be charged.
4.4 Managing and Canceling Subscriptions
You can manage or cancel your subscription at any time through your Apple ID account settings (Settings > [your name] > Subscriptions) or through the App Store. Cancellation takes effect at the end of the current billing period — you will retain access to premium features until that date.
4.5 Refunds
All purchases are processed by Apple through the App Store. We do not process payments directly. Refund requests must be directed to Apple in accordance with their refund policies. We cannot issue refunds on Apple’s behalf.
4.6 Subscription Lapse
If your subscription expires or is canceled, your locally stored data (food logs, profile, body composition history) remains on your device and is not deleted. Access to premium features will be restricted until you re-subscribe. Re-subscribing restores access to all premium features immediately.
4.7 Price Changes
We may change subscription pricing at any time. Price increases for existing subscribers will take effect at the start of the next billing period following notice, in accordance with Apple’s policies. You will have the opportunity to review and accept any price changes before being charged.
5. AI-Powered Features
5.1 Third-Party AI Services
Deficit uses third-party artificial intelligence services — specifically the Anthropic API (Claude) and OpenAI API — to power food detection from photos and text descriptions. When you use these features, your food photos and/or text are sent from your device to our server, which forwards them to these AI providers for processing.
5.2 Consent
Before using AI-powered food detection for the first time, you will be asked to consent to this data processing. You may decline and continue using the App without AI features. You can stop using AI-powered features at any time.
5.3 AI Accuracy
AI-powered food detection provides estimates only. Results may be inaccurate, incomplete, or incorrect. AI features are provided on an “as-is” basis. You should not rely solely on AI-generated nutritional information for dietary decisions, and you are responsible for verifying the accuracy of any AI-generated results. We do not guarantee the accuracy, completeness, or reliability of any AI-generated content.
5.4 AI Data Handling
Photos and text processed by AI services are handled in real-time and are not permanently stored on our servers or by our AI providers. We use API configurations designed to prevent the use of your data for model training. For details, see our Privacy Policy.
6. Third-Party Food Data
6.1 FatSecret
The App uses the FatSecret Platform API for food search and nutritional information. By using Deficit, you agree to be bound by FatSecret’s Terms of Use, available at https://www.fatsecret.com/terms-and-conditions. Nutritional data sourced from FatSecret is provided by FatSecret and is subject to their terms and accuracy disclaimers.
6.2 Open Food Facts
Certain food and nutrition data in the App may be sourced from Open Food Facts (https://world.openfoodfacts.org), a collaborative, free, and open database. This data is made available under the Open Database License (ODbL): https://opendatacommons.org/licenses/odbl/1.0/. Individual contents of the Open Food Facts database are available under the Database Contents License: https://opendatacommons.org/licenses/dbcl/1.0/. Open Food Facts data is contributed by volunteers and may contain errors or inaccuracies.
6.3 USDA FoodData Central
Some nutritional information may be sourced from USDA FoodData Central, a public domain resource published by the U.S. Department of Agriculture, Agricultural Research Service. This data is in the public domain under CC0 1.0 Universal.
6.4 Accuracy of Third-Party Data
Nutritional information sourced from third-party databases — including FatSecret, Open Food Facts, and USDA FoodData Central — is provided for informational purposes only. We do not guarantee the accuracy, completeness, or currency of any third-party nutritional data. Data may contain errors, outdated information, or values that differ from the actual nutritional content of foods you consume. You are responsible for verifying nutritional information against product labels or other authoritative sources.
7. Apple HealthKit
7.1 Use of Health Data
With your explicit permission, Deficit reads data from Apple HealthKit (weight, body fat, steps, and workouts) to display health metrics and inform your nutrition goals within the App.
7.2 Restrictions
In accordance with Apple’s HealthKit guidelines:
- Health data is never sent to our servers or any third party.
- Health data is never used for advertising, marketing, or data mining purposes.
- Health data is not stored in iCloud or any external service.
- Health data is used solely for the App’s core functionality of tracking your health metrics and calculating personalized goals.
7.3 Permissions
HealthKit integration is entirely optional. If you do not grant HealthKit permissions, the App remains fully functional — you can enter health data manually. You can revoke HealthKit access at any time in iOS Settings > Privacy & Security > Health.
8. Health and Medical Disclaimer
DEFICIT IS NOT A MEDICAL DEVICE AND DOES NOT PROVIDE MEDICAL ADVICE, DIAGNOSIS, OR TREATMENT. The App is intended for general wellness and informational purposes only.
Calorie, protein, macronutrient, and body composition calculations are estimates based on standard nutritional formulas (including the Cunningham equation for basal metabolic rate). These calculations may not be accurate for your individual circumstances.
The App’s weekly evaluation system, goal adjustment recommendations, and weight projections are automated assessments based on mathematical models. They do not constitute medical advice or professional dietary guidance.
You should always consult a qualified healthcare provider before:
- Starting, modifying, or ending any diet or nutrition program
- Making dietary decisions based on information from this App
- Using this App if you have a medical condition, eating disorder, or are pregnant or nursing
Nutritional data sourced from third-party databases (including FatSecret, Open Food Facts, and USDA) should not be interpreted as a substitute for consulting a medical physician, and such data may contain inaccuracies. You acknowledge that following any nutritional advice or information provided through the App is at your own risk.
9. Acceptable Use
You agree not to:
- Use the App for any unlawful purpose
- Attempt to reverse-engineer, decompile, or disassemble any part of the App
- Interfere with or disrupt the App’s servers, APIs, or connected services
- Use automated systems (bots, scrapers) to access the App or its associated services
- Circumvent any security measures or access restrictions
- Misuse the AI food detection feature by submitting content unrelated to food identification
- Resell, sublicense, or redistribute any nutritional data obtained through the App
10. Intellectual Property
10.1 Our Property
The App, including its design, code, features, algorithms, and original content, is owned by Deficit and protected by intellectual property laws. These Terms do not grant you any right, title, or interest in the App except for the limited license to use it in accordance with these Terms.
10.2 Your Data
You own your data. All food logs, profile information, goals, and other data you enter into the App remains yours. We do not claim any ownership rights over your data. Because your data is stored locally on your device, you maintain full control over it at all times.
10.3 Third-Party Content
Nutritional data, food descriptions, and product information sourced from FatSecret, Open Food Facts, USDA FoodData Central, and other third-party sources remain the property of their respective owners and are subject to their respective licenses and terms.
11. Disclaimer of Warranties
THE APP AND ALL CONTENT, FEATURES, AND SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, WE DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, AND ACCURACY.
WITHOUT LIMITING THE FOREGOING, WE DO NOT WARRANT THAT:
- THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE
- NUTRITIONAL INFORMATION WILL BE ACCURATE, COMPLETE, OR CURRENT
- AI-POWERED FOOD DETECTION WILL CORRECTLY IDENTIFY FOODS OR PROVIDE ACCURATE NUTRITIONAL ESTIMATES
- THE APP WILL BE COMPATIBLE WITH ANY PARTICULAR DEVICE OR OPERATING SYSTEM VERSION
- RESULTS OBTAINED FROM THE APP WILL BE ACCURATE OR RELIABLE
Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you. In such cases, our warranties are limited to the minimum extent permitted by applicable law.
12. Limitation of Liability
TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DEFICIT, ITS OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF DATA, LOSS OF PROFITS, PERSONAL INJURY, OR PROPERTY DAMAGE, ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF OR INABILITY TO USE THE APP.
OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THESE TERMS OR YOUR USE OF THE APP SHALL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU HAVE PAID TO US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED U.S. DOLLARS ($100).
THE LIMITATIONS IN THIS SECTION APPLY REGARDLESS OF THE THEORY OF LIABILITY (WHETHER CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Some jurisdictions do not allow the limitation or exclusion of liability for incidental or consequential damages, so the above limitations may not apply to you.
13. Indemnification
You agree to indemnify, defend, and hold harmless Deficit and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with: (a) your use of the App; (b) your violation of these Terms; (c) your violation of any rights of a third party; or (d) any dietary or health decisions you make based on information from the App.
14. Dispute Resolution
14.1 Informal Resolution
Before initiating any formal dispute resolution, you agree to first contact us at legal@deficitapp.io and attempt to resolve the dispute informally for at least sixty (60) days. Most concerns can be resolved through informal communication.
14.2 Binding Arbitration
If we cannot resolve a dispute informally, you and Deficit agree to resolve any claims through binding individual arbitration administered by the American Arbitration Association (“AAA”) under its Consumer Arbitration Rules. Arbitration will be conducted in English and the arbitrator’s decision shall be final and binding.
14.3 Class Action Waiver
YOU AND DEFICIT AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN YOUR OR ITS INDIVIDUAL CAPACITY, AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION. The arbitrator may not consolidate more than one person’s claims and may not preside over any form of representative or class proceeding.
14.4 Opt-Out
You may opt out of the arbitration and class action waiver provisions by sending written notice to legal@deficitapp.io within thirty (30) days of first using the App. Your notice must include your name, mailing address, and a clear statement that you wish to opt out. If you opt out, disputes will be resolved in the courts specified in Section 15.
14.5 Exceptions
Either party may bring claims in small claims court if the claim qualifies. Either party may seek injunctive or equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement of intellectual property rights.
15. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions. If the arbitration provisions in Section 14 do not apply, you agree to submit to the personal and exclusive jurisdiction of the courts located in Delaware.
16. General Provisions
16.1 Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Deficit regarding the App and supersede all prior agreements and understandings.
16.2 Severability
If any provision of these Terms is found to be unenforceable, the remaining provisions shall remain in full force and effect.
16.3 No Waiver
Our failure to enforce any provision of these Terms shall not constitute a waiver of that provision or any other provision.
16.4 Assignment
You may not assign or transfer your rights under these Terms without our prior written consent. We may assign our rights and obligations without restriction.
16.5 Third-Party Beneficiaries
These Terms do not create any third-party beneficiary rights, except that FatSecret, Anthropic, and OpenAI are intended third-party beneficiaries of Sections 6.1, 5, and 11 respectively, solely with respect to disclaimers and limitations applicable to their services.
16.6 Apple-Specific Terms
You acknowledge that these Terms are between you and Deficit, and not with Apple Inc. (“Apple”). Apple is not responsible for the App or its content. To the extent these Terms conflict with Apple’s Licensed Application End User License Agreement, Apple’s terms govern for the conflict only. Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you.
17. Open Source and Attribution
The App incorporates the following open data sources and licenses:
- FatSecret: Food and nutrition data powered by FatSecret. Subject to FatSecret Terms of Use (https://www.fatsecret.com/terms-and-conditions).
- Open Food Facts: Contains information from Open Food Facts (https://world.openfoodfacts.org), made available under the Open Database License (https://opendatacommons.org/licenses/odbl/1.0/).
- USDA FoodData Central: Nutritional data from the U.S. Department of Agriculture, Agricultural Research Service. FoodData Central, public domain (CC0 1.0).
